OpenAI is hoping to use regulatory uncertainty to suppress Kimi K3, David Sacks publicly refutes and supports the open-sourcing of the model

According to Trend Watch Beating, President's Science and Technology Advisory Committee Chair David Sacks has just publicly criticized OpenAI's Strategy Lead, Dean W. Ball. Ball's post pointed out that the performance of the Kimi K3 model on the dark side of the moon has approached the top publicly available models in the first quarter of 2026, suggesting that the U.S. government deliberately create regulatory uncertainty to deter regulated entities from using it.

Sacks directly refuted this claim: "Weaponizing regulatory uncertainty as a competitive tool is completely unacceptable. Regulatory decisions must be based on facts, logic, and evidence, rather than deliberately creating fear and uncertainty."

Sacks further warned that this surreptitious practice of achieving goals by sowing doubt will erode the rule of law in the United States and set a precedent for future abuses of power against anyone. He called on the Silicon Valley majority supporting open competition to come forward and make their voices heard.
