CFTC Warning: Event Contracts Displaying "American Odds" May Be Misleading and Must Clearly Present Derivative Pricing Information

Regulators specifically warned that using the "American odds" format to display pricing information may lead market participants to misunderstand the nature of the trades and could prevent users from accessing key metrics such as market depth and pricing impact. Previously, Kalshi faced charges in New York for its event contracts, and Polymarket came under regulatory scrutiny for its settlement mechanism and false advertising. This CFTC warning further delineates the compliance boundaries for prediction markets.

The CFTC emphasized that the information displayed by market participants (including pricing information) should indicate to consumers that the product is an event contract traded on a CFTC-regulated exchange, rather than a higher-profit, non-market-priced product. Regulated entities are required to uphold regulatory standards by overseeing intermediary market participants, affiliates, and partners. Displaying misleading pricing information may violate federal laws prohibiting the use of manipulative tactics.
